Rights, obligations, and responsibilities for using BIOFOX services.
The purpose of this Agreement is to prescribe the rights, obligations, and responsibilities of the Cyber Mall and users in using the internet-related services (hereinafter referred to as the "Service") provided by the BIOFOX Cyber Mall (hereinafter referred to as the "Mall") operated by Dermanova Co., Ltd. (e-commerce business operator).
※ 「This Agreement shall apply mutatis mutandis to e-commerce using PC communication, wireless, etc., unless it violates its nature.」
① "Mall" refers to a virtual business place set up by Dermanova Co., Ltd. to trade goods or services (hereinafter referred to as "Goods, etc.") using information and communication facilities such as computers to provide Goods, etc. to users, and is also used as the meaning of the business operator operating the Cyber Mall.
② "User" refers to members and non-members who access the "Mall" and receive services provided by the "Mall" in accordance with this Agreement.
③ "Member" refers to a person who has registered as a member of the "Mall" and can continuously use the services provided by the "Mall".
④ "Non-member" refers to a person who uses the services provided by the "Mall" without registering as a member.
① The "Mall" shall post the contents of this Agreement, trade name, representative's name, business address (including the address where consumer complaints can be handled), telephone number, fax number, email address, business registration number, mail-order business report number, and personal information management manager on the initial service screen (front) of the BIOFOX Cyber Mall so that users can easily know them. However, the contents of the Agreement can be viewed by the user through a connection screen.
② Before the user agrees to the Agreement, the "Mall" shall provide a separate connection screen or pop-up screen so that the user can understand important contents such as withdrawal of subscription, delivery responsibility, refund conditions, etc., defined in the Agreement and seek the user's confirmation.
③ The "Mall" may amend this Agreement to the extent that it does not violate relevant laws such as the 「Act on Consumer Protection in Electronic Commerce, Etc.」, 「Act on Regulation of Terms and Conditions」, 「Framework Act on Electronic Documents and Transactions」, 「Electronic Financial Transactions Act」, 「Digital Signature Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.」, 「Act on Door-to-Door Sales, Etc.」, and 「Framework Act on Consumers」.
④ When the "Mall" amends the Agreement, it shall specify the application date and the reason for the amendment and announce it on the initial screen of the Mall along with the current Agreement from 7 days prior to the application date to the day before the application date. However, if the contents of the Agreement are changed disadvantageously to the user, a grace period of at least 30 days shall be given in advance. In this case, the "Mall" shall clearly compare the contents before and after the amendment and display them so that users can easily understand them.
⑤ If the "Mall" amends the Agreement, the amended Agreement shall only apply to contracts concluded after the application date, and the provisions of the Agreement before the amendment shall apply to contracts already concluded before that date. However, if a user who has already signed a contract sends a wish to be subject to the provisions of the amended Agreement to the "Mall" within the announcement period of the amended Agreement under Paragraph 3 and obtains the consent of the "Mall", the provisions of the amended Agreement shall apply.
⑥ Matters not defined in this Agreement and the interpretation of this Agreement shall be governed by the Act on Consumer Protection in Electronic Commerce, Etc., the Act on Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, Etc. set by the Fair Trade Commission, and relevant laws or commercial practices.

(Effective Date) This Agreement shall be effective from January 1, 2024.
